Terms of Use

These terms govern every use of toptake.best: reading the leaderboard, voting, submitting a project and paying for a Boost. Using the service means entering a binding agreement with the operator named above.

If you do not accept them, do not use the service.

You accept these terms by ticking the acceptance box when you submit a project, and again by confirming a Boost.

Each acceptance is recorded together with the version of the text in force at that moment. Previous versions stay available, so what was agreed and when can always be established.

You must be at least 18 and legally able to enter a contract. If you act for a company, you confirm you are authorised to bind it.

If you enter a project you do not own, you confirm the owner has agreed to it being entered.

You keep every right you already hold in your project. Nothing here transfers ownership.

You grant us a non-exclusive, worldwide, royalty-free licence to display the name, tagline, description, logo and link you provide, and to reproduce them in leaderboards, share images, social posts and archives, for as long as the project or its past results stay published.

You warrant that the material is yours to submit, that it is accurate, that it is lawful, and that it infringes nobody else's rights.

You may ask us to remove a project at any time. Results of weeks already finished remain: a competition record that can be edited afterwards is not a record.

Every submission is reviewed before publication and no listing is guaranteed.

We may reject, delay, edit for length or format, unlist or permanently remove any project or supporter name, at our discretion and without prior notice, in particular where content is misleading, unlawful, harmful, impersonates someone, or damages the integrity of the competition.

Removal for breach of these terms gives no right to a refund of a Boost already delivered.

A Boost is the purchase of a promotional service at a fixed price. In exchange you receive one defined thing: the amount is converted into Momentum for the project you name, for the current competition week only, under the published formula, and the display name and link you choose may be shown as a supporter of that project.

A Boost is expressly not a donation, not a gift, not a charitable contribution, not a subscription, not a loan, and not crowdfunding. It is not the acquisition of any share, equity, token, security, revenue share or financial instrument of any kind, in the project you support or in TopTake. It confers no ownership, no repayment right, no voting right, no control, and no expectation of profit or of any return, financial or otherwise.

The money is paid to the operator, as the price of a service the operator supplies. It is not passed on to the project, to its creator, or to any third party, and neither the project nor its creator acquires any claim over it.

What you buy is the effect of the formula, never a position. Momentum is one input into an order that also depends on what everyone else does; no rank, no visibility, no traffic and no outcome of any kind is promised, and every score resets when the week ends.

A ranking is not an endorsement of a project, and you must not describe a Boost to anyone as a donation, an investment, or as funding for a project.

A Boost is delivered instantly: the Momentum is applied the moment payment is confirmed.

By confirming a Boost you expressly ask us to begin performing the service immediately, and you acknowledge that once it has been performed in full you lose the right of withdrawal that EU consumers otherwise have under Article 16(a) of Directive 2011/83/EU. There is accordingly no refund for a Boost already applied, including where the project is later removed, where the week ends, or where the result disappoints you.

None of this limits a right your own country's law grants you and does not allow to be waived. Where the law requires a refund, or where the service failed through our fault, you get one.

The ranking can be influenced by payment, and we say so everywhere it is shown.

The main parameters (free votes, Boosts, converted referrals and recent supporter activity) and the weight each one carries are published in full on the “How ranking works” page, together with the diminishing-returns curve that governs paid amounts.

This disclosure is made under the Unfair Commercial Practices Directive 2005/29/EC as amended by Directive (EU) 2019/2161.

The competition only means something while the numbers are honest. You must not vote by automated means, create multiple identities, buy or trade votes, manipulate referrals, or interfere with the service or its infrastructure.

Where we find a score was obtained that way we may void the affected Momentum, adjust or annul a week's result, remove the project and refuse future entries. Money spent on a Boost that formed part of such an attempt is not refunded.

The service is provided as it is and as it is available. We do not warrant that it will be uninterrupted or error-free.

Listed projects are third-party products we neither build nor control. We do not warrant that any of them is safe, functional, lawful or as described, and following a link takes you outside TopTake and outside these terms. Check anything you are about to use or pay for.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for indirect or consequential loss, for lost profit, revenue, data or business opportunity, or for the acts of any listed project. Our total liability to you for all claims arising in any twelve-month period is limited to the total amount you paid us in that period.

We collect only what the service needs: the email address you give when submitting a project, used to reply about that submission and never published; the display name and link you choose when boosting, which are public because you chose them; and the payment records we are legally required to keep.

We do not sell personal data. You may request access, correction, deletion or a copy of your data at info@digitalrose.org, and you may complain to your national data protection authority.

We may change these terms. The version identifier at the top changes with them, and a substantive change is announced on the site before it takes effect.

Changes never apply retroactively to a Boost already paid or a week already finished. Those stay governed by the version you accepted.

These terms are governed by the law of Bulgaria, courts of Shumen and disputes are heard by its courts.

If you use the service as a consumer resident in the European Union, this does not deprive you of the protection of the mandatory rules of your own country, and you may use the European Commission's online dispute resolution platform.

If any provision turns out to be unenforceable, the rest continue to apply.
